At Deming Public Schools, our priority is to provide a safe, supportive, and inclusive learning environment for every student, regardless of their immigration status. Federal law, specifically the Supreme Court decision in Plyler v. Doe, ensures that all students have the right to a public education, and as such, we do not ask for or maintain records of students’ immigration status.

Our district is also governed by the Family Educational Rights and Privacy Act (FERPA), which strictly protects the confidentiality of student education records. We comply with all legally supported requests while ensuring we uphold these privacy protections.

Regarding the possibility of ICE (Immigration and Customs Enforcement) operations on or near school grounds, our stance is guided by a commitment to the safety and well-being of our students and their families. It is our understanding that schools are generally considered “sensitive locations” under ICE policies, meaning enforcement actions should not typically take place on school grounds. If any such situation arises, we will work closely with our legal counsel and relevant authorities to address it in a way that prioritizes our students’ safety while adhering to the law.
